65);"><strong>袁某等四人受伤，三车和公路设施不同程度受损的道路交通事故。</strong></span></p><p style="white-space: normal;"><br/></p><p style="white-space: normal;"><span style="letter-spacing: 1px;"> </span><span 0);">交警部门出具《道路交通事故认定书》，认为驾驶人胡某在驾驶机动车的过程中注意力不集中，未按照操作规范安全驾驶机动车，负事故主要责任。驾驶人何某、贺某在发生交通事故后，未按照规定及时摆放警示标志，负事故共同次要责任。原告等人无与此次道路交通事故发生有因果关系的违法行为，不负事故责任。原告袁某等遂将被告胡某、何某、贺某、保险公司、某高速公司诉至法院，要求各被告赔偿因交通事故造成的各项损失200余万元。</span></p><p 1px;">案涉交通事故责任认定书只对案涉三车之间的责任比列进行划分，对于本次事故的直接起因未作认定，对该交通事故认定书中三车之间的责任认定，法院予以采信。对于本案事故的起因，根据原告提交的案涉事故现场视频录像、被告贺某提交的一组照片以及法院调取交警部门在本次事故的询问笔录等相关证据，结合庭审中被告汤某、被告贺某等的陈述，形成了一个较为完整的证据链，具有高度的盖然性，足以认定<span style="letter-spacing: 1px;">本次事故的起因系被告贺某驾驶的车辆撞击遗落在高速公路货车轮胎</span>，导致其车辆受损无法正常行驶而停在高速公路车道上，<span style="letter-spacing: 1px;">从而引发后续的三车追尾事故。</span></span></p><p style="white-space: 其次，被告某高速公司作为事故发生地的高速公路道路管理部门，具有保障高速公路畅通、安全的义务。且案涉高速公路系收费封闭管理路段，作为管理者，被告某高速公司对案涉高速公路相关路段享有管理及支配权，并且因从事该道路的管理活动而能够获取收益，应承担比其他公路管理者更重的管理义务。本案中，某高速公司认为在当日对事发路段进行清扫和巡逻已尽到了安全保障义务，但案涉事故的遗落物为整个轮胎，体积较大，某高速公司作为路段管理者至今未能结合监控录像等管理技术手段找出案涉轮胎遗落人，也不能证明轮胎的遗落时间系在其定点巡查时间之外遗落以完全排除其责任，其并未尽到了安全防护、警示等管理维护义务，故其应对本次事故承担相应的责任。此次事故为三车连环相撞，三车自身均有的一定过错。本院酌定，某高速公司对事故总损失承担30%的责任。</span></p><p style="white-space: normal;"><br/></p><p style="white-space: normal;"><span style="letter-spacing: 1px;"> </span><span style="letter-spacing: 1px;color: rgb(0, 0, 0);"> 某高速公司赔偿后，各被侵权人剩余各项损失均按70%计算，该损失应先由交强险赔付，余下损失由原、被告按责任比例承担。本次事故中，原告袁某等人未系安全带，对自身的损失发生、扩大存在一定的过错，本院酌定对各自的损失承担10%。在减去某高速公司赔偿责任、交强险赔偿以及原告自身承担的损失后，对于剩余损失，结合本案案情、各方过错等因素，法院酌定被告胡某应承担责任比例为60%，被告何某承担的责任比例为20%，被告贺某承担的责任为20%。</span></p><p
